The Executive section of the Office of General Counsel provides contracts and personnel counsel, financial and bankruptcy counsel and administrative law counsel. The section also serves as the Environmental Regulation Commission Liaison, the Agency Clerk and the Department economist.

Agency Clerk
The Agency Clerk is responsible for keeping records all official legal documents received by the Department of Environmental Protection including petitions and orders.

Enforcement
The Enforcement section of the Office of General Counsel represents the Department of Environmental Protection in all administrative or judicial enforcement actions. In addition to handling enforcement litigation, the attorneys in this section participate in enforcement settlement negotiations, review and drafting of consent orders and notices of violation, assist in training department enforcement staff and provide general legal advice.

Defense
The Defense Section of the Office of General Counsel is the defense
counsel for all of the Department’s regulatory programs. It provides
legal advice and representation to the Division of Air Resource
Management, Siting Coordination Office, Division of Waste
Management, Division of Water Resource Management, and the
Department’s six regulatory districts concerning permitting issues.
It also represents these Divisions when existing or proposed rules
or variances are challenged. Finally, it also reviews and approves
proposed restrictive covenants for the divisions and regulatory
districts.

Program
The Program Section of the Office of General Counsel is program counsel for all of the Department’s regulatory programs. It provides legal advice to the Division of Air Resource Management, Division of Waste Management, Division of Water Resource Management, Division of Environmental Assessment & Restoration, the Office of Water Policy, and the Department’s six regulatory districts concerning program issues. The Section also houses the Department’s economists.

Public Lands
The Public Lands section of the Office of General Counsel is counsel to the Board of Trustees of the Internal Improvement Trust Fund, the Divisions of State Lands, Recreation and Parks, Law Enforcement, Office of Greenways and Trails and the Office of Coastal and Aquatic Managed Areas. The attorneys handle contract review, closings and closing audits for state land acquisitions. They also review leases, easements and other land use agreements for submerged lands and state owned uplands.
